This agreement ("user agreement") constitutes a binding contract between you, the User, and Sikkim Tourism Development Corporation (A Government of Sikkim Undertaking) with regard to the use of various services that are provided by Sikkim Tourism Development Corporation (STDC).
The user agreement, as may be amended from time to time, applies to all our services directly or indirectly made available online, through any mobile device, by email or by telephone. The User shall be responsible for regularly reviewing these terms and conditions. By accessing, browsing and using our website or any of our applications through whatever platform (hereafter collectively referred to as the "website" i.e. www.sikkimstdc.com) and/or by completing a reservation, you acknowledge and agree to have read, understood and agreed to the terms and conditions set out below (including the privacy statement).
Scope of our Service
Through this website (www.sikkimstdc.com) we provide an online platform through which travel-related information, pricing, availability and reservations for hotels, tour packages, vehicle within Sikkim and surrounding areas ("Service/s). These Services may be availed by the User in India at any time during the year as is offered by various third party vendors like hotels, Vehicle Owner, Travel Agents etc. ("Service Providers").
STDC has endeavored to ensure that all the information provided by it is correct, but neither warrants nor makes any representations regarding the quality, accuracy or completeness of any data or information. STDC makes no warranty, express or implied, concerning the Website and/or its contents and disclaims all warranties of fitness for a particular purpose and warranties of merchantability in respect of services, including any liability, responsibility or any other claim, whatsoever, in respect of any loss, whether direct or consequential, to any User or any other person, arising out of or from the use of any such information.
Through this website (www.sikkimstdc.com) we provide an online platform through which service provider can register with STDC to advertise their services for reservation/booking, and through which visitors to the website can make such reservations. By making a reservation through www.sikkimstdc.com, you enter into a direct (legally binding) contractual relationship with the service provider at which you book. From the point at which you make your reservation, we act solely as an intermediary between you and the provider, transmitting the details of your reservation/booking to the relevant service provider and sending you a confirmation email for and on behalf of the service provider.
When rendering our services, the information that we disclose is based on the information provided to us by the service providers. Although we will use reasonable skill and care in performing our services we cannot guarantee that, all information is accurate, complete or correct, nor can we be held responsible for any data entry errors (including manifest and typographical errors), any interruptions (whether due to any (temporary and/or partial) breakdown, repair, upgrade or maintenance of our website or otherwise), inaccurate, misleading or untrue information or non-delivery of information. STDC at its sole discretion reserves the right not to accept any order placed by the User through the Website without assigning any reason thereof.
The maximum liability on part of STDC arising under any circumstances, in respect of any Services availed, shall be limited up to a maximum of the refund of total amount received from the User/customer for providing the services less any cancellation, refund or others charges, as may be applicable. In no case STDC shall be liable for any consequential loss, damage or additional expense whatsoever. In no event STDC shall be liable for any kind of refunds/returns of charges/fee/fares paid to Service Provider for rendering the services to User/customer.
This site also contains various tourism related information. The information is provided by STDC with an intention of imparting no more than general information. We make an effort to keep the latest and correct information, we make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability or availability with respect to the website or the information, products, services, or related graphics contained on the site for any purpose. Any reliance you place on such information is therefore strictly at your own risk. In no circumstances STDC will be accountable to any loss or damage including without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising from loss of data or profits arising out of or in connection with the use of information from this site.

The Linked Sites are not under the control of STDC or STDC is not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. STDC is not responsible for any form of transmission, whatsoever, received by the User from any Linked Site. STDC is providing these links to the User only as a convenience, and the inclusion of any link does not imply endorsement by STDC or the Website of the Linked Sites or any association with its operators or owners including the legal heirs or assigns thereof.
The Website also contains services such as user registration, chat, and sends feedback and queries. The User agrees and undertakes to use the these services only to post, send and receive messages and material that are proper and related to the tourism. The User agrees and undertakes that User will not:
- Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights of others
- Publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topic, name, material or information
- Upload files that contain software or other material protected by intellectual property laws unless the User owns or controls the rights thereto or have received all necessary consents
- Upload or distribute files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of the Website or another's computer
- Violate any of the terms and conditions of this Agreement or any other terms and conditions for the use of the Website contained elsewhere herein.
STDC reserves the right at all times to disclose any information as is necessary to satisfy or comply with any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part.
The User represent and confirm that the User is of legal age to enter into a binding contract and is not a person barred from availing the Services under the laws of India or other applicable law.
The User also understands that the Services may include certain communications from STDC as Service announcements and administrative messages. The User understands and agrees that the Services are provided on an "as is" basis and that STDC does not assume any responsibility for deletions, mis-delivery or failure to store any User communications.
User may register with STDC if he/she wishes to. If the User chooses to register with us, upon completion of the registration process, the User shall receive a user id through email. The User agrees and undertakes at all times to be responsible for maintaining the confidentiality of the password and user id, and shall be fully responsible for all activities that occur by use of such password or user id. The user confirm that you are the authorized holder of the credit/debit card or the original account holder used in the transactions you make using the STDC services. STDC will not be responsible for any financial loss, inconvenience or mental agony resulting from misuse of your ID/password/credit card number/account details number for using STDC Services.
The User also agrees to provide accurate and complete information about himself/herself and his/her beneficiaries as prompted by the registration form ("Registration Data") on the Website and maintain the Registration Data accurate, current and complete. If the User provides any information that is untrue, inaccurate or incomplete, STDC has reasonable grounds to suspect such information and reserves right to suspend or terminate the User's registration and refuse any and all current or future use of the Website and/or any Service.
The headings and subheadings herein are included for convenience and identification only and are not intended to describe, interpret, define or limit the scope, extent or intent of this Agreement, the right to use the Website by the User contained herein or any other section or pages of the Website or any Linked Sites in any manner whatsoever.
Our services are made available for personal and non-commercial use only. Therefore, user are not allowed to re-sell, deep-link, use, copy, display, reproduce any content or information, software, products or services available on our website for any commercial or competitive activity or purpose.
The prices on our site are highly competitive. All prices on the www.sikkimstdc.com website are per room for your entire stay and are displayed including VAT tax and all other taxes (subject to change of such taxes), unless stated differently on our website or in the confirmation email.

This agreement, Privacy Policy and Terms of Service shall be governed by and constructed in accordance with the laws of India without reference to conflict of laws principles and disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the courts of Gangtok, East Sikkim, India.
